User agreement for My Business

1. Parties to the Agreement

The parties of this Agreement are If P&C Insurance Ltd (publ), org. no. 516401-8102, including its branches in Denmark, Norway and Finland (hereinafter If) and If's customer or customer’s insurance broker (hereinafter the User), which has accepted the terms of this Agreement by logging in to the My Business service (hereinafter My Business). User, in its capacity as insurance broker, may only access and use My Business provided the insurance broker is an authorized insurance intermediary and holds a valid power of attorney to represent If’s customer.

2. Contents of the Agreement

 This Agreement concerns the use of My Business (hereinafter the “Agreement”). The terms of the Agreement may be amended in accordance with section 11. In addition to this Agreement, any service-specific contractual terms and instructions, as specified in connection with each service or otherwise, shall apply.

How to administrate access

  1. Log in to My Business with Bank-ID

  3. Next to the name of the user, click on the dots and change access

3. My Business services and Authorized representatives

My Business is an electronic service provided by If. The User may appoint a representative either of the User or of the party to whom the User has delegated access right to My Business (hereinafter Authorized representative). Login takes place with BankID and both User and Authorized representative accept the terms of the Agreement the first time they log in to My Business.

4. Paperless service

The User may choose digital customership with a paperless service. If the User opts for paperless service, some insurance documents such as policy documents; terms and conditions governing the insurance; and claim documents such as claim decisions and communication related to claims are sent digitally to MyBusiness only. Any documents not delivered digitally to MyBusiness will sent to the User by post on paper. 5. Other Service Providers’ Services within My Business

If may also incorporate, in My Business, documents and information provided by other service suppliers. Through My Business, If may also distribute services supplied by other service providers. If the User subscribes to such services, it undertakes to observe the terms of use of said service providers. If is not liable for the services, any errors in the information contained therein or for the usability of services provided by other service providers.

If has the right to store the documents supplied by If, the User or a third party, as well as any risk management documents in My Business, unless the User has expressly prohibited this. 

6. User’s and Authorized representative’s obligations

The User administers all access rights concerning the customer’s use of My Business. The User defines to what extent a person acting on behalf of the customer has authority to use My Business and have access to the information published in My Business. The User is responsible for providing user authorization for My Business solely to persons considered to require them for handling their tasks at work, and for ensuring that these persons do not disclose to third parties confidential information accessed through My Business. The User is responsible for ensuring that only the User and Authorized representative have access to My Business. The User is responsible for all actions performed when the login has been made by an Authorized representative.

The User agrees to keep all access rights up-to-date. The User is responsible for deleting the access to My Business for an Authorized representative if the Authorized representative has left If's customer or no longer shall have access. The User must also inform If if a power of attorney for the insurance intermediary is terminated.

The User shall, at its own cost, acquire any hardware, software and data connections required for using My Business and be responsible for their operating and maintenance costs as well as security (including appropriate anti-virus and malware protection) and functionality.

The User shall not (or allow anyone else to) modify My Business or its components or any data packages and layers (or parts thereof) in any way, copy, perform screen-scraping, hide, sell, rent, sub-license, give away or otherwise transfer.

The User also agrees not to remove or destroy any trademarks or any other intellectual property rights placed upon or contained within My Business or its components, or information and results derived from using My Business, including third party notices or copyright information, and will keep such source information as is. 

The User shall use My Business in its intended way and shall neither manipulate requests, nor create technical interfaces to My Business or its components which enable the extraction of data.

7. IP Rights

The internet site relating to My Business contains material protected under copyright, trademarks and other intellectual property rights (hereinafter IP Rights). If owns the IP Rights relating to My Business site and materials.

User may not, neither electronically or otherwise, disseminate, publish, link, copy, make available to the public or otherwise utilize the protected information contained by My Business without the prior written consent of If.

8. Handling of personal data and data authentication

If and User undertake to handle personal data in accordance with governmental privacy regulations and other applicable laws. If use the personal data with the purpose to provide My Business. Please also see If’s privacy notice, Handling personal data (if-insurance.com).

If has the right to store information in its information system on the User's contacts and dealings with If.

9. Limitation of access

If may limit or terminate the User’s or an Authorized representative’s access to My Business, permanent or temporary, in case of breach of any of the obligations in this Agreement or any service-specific contractual terms or instructions, or if this Agreement has been terminated.   

10. Disclaimer and exclusion of liability

User acknowledges that the service provided through My Business is free of charge and that information and documents available in My Business have been compiled from various databases. Hence, If cannot guarantee that the information and documents in My Business are at all times correct, complete or represent the latest version. If there is any inconsistency or conflict between the information in documents available through My Business and what the parties have agreed, the parties’ agreement shall prevail. Moreover, the information contained in My Business cannot be regarded as offers or commitments that are binding upon If, unless explicitly specified.

If is not liable for any damage or loss, regardless if direct or indirect, resulting from the use of My Business. If is neither liable for any loss or damage arising from errors in the services or information in My Business or if My Business is not available. 

11. Third party infringement – indemnity and hold harmless obligation

If the User has breached any term of this Agreement or any other user term provided to the User, the User is responsible for any claim regarding infringement of third party intellectual property rights as a result of the breach. The User shall defend or settle at its own expense any claim which may be brought against If for the alleged infringement of third party intellectual property rights and the User shall indemnify and hold harmless If from and against all damages and costs that may be adjudged against If in respect of such infringement caused due to non-compliant use of My Business or its parts thereof.

12. Changes

If has the right to change the contractual terms, instructions for use and prices applicable to My Business. If shall inform the User of any such changes by email, letter or when logging in to My Business and the changes shall enter into force on the date specified in the notification of change.

The User accepts the new terms, instructions or prices by continuing using My Business after the date stipulated in the notice for when the changes enter into force.

13. Entry into force and termination

This Agreement shall enter into force when the User or an Authorized representative for the first time has logged in to My Business. The Agreement is valid until further notice.

Either party may terminate the Agreement without cause and with immediate effect, in other words, without a term of notice. Such a termination must be made in writing, except for in situations when the User no longer is a customer of If, in which case the Agreement is terminated automatically. Within three months following termination the User shall, upon request to If, be granted a right to access My Business for the purpose of copying or printing data available in My Business concerning the User.
